Terms and Conditions

The terms on which Flightright offers its air passenger rights service, including how a contract is formed, our fees, and the limits of our responsibility.

The service we provide

Flightright GmbH is a debt collection service provider pursuant to Section 10(1)(1) of the German Legal Services Act (RDG). We assess, prepare and enforce air passenger compensation claims on your behalf and, where required, engage our contract law firms.

Forming the contract

A contract is formed when you submit a claim through the calculator and confirm the authorisation that lets us act for you. You appoint us to pursue the claim; redemption is possible by the airline only to us, and we account to you for the proceeds.

Fees and VAT

There is nothing to pay to use the calculator, and nothing at all if a claim is unsuccessful — including where a case reaches court. Where we recover compensation, our success fee of 20–30% (plus VAT) is deducted. Where a case must be passed to our contract lawyers and enforced in court, a statutory solicitor’s surcharge of 14% applies, again only on success.

What we need from you

  • Accurate flight and booking details, and prompt answers when we ask for them.
  • Documents you have — boarding passes and receipts are especially useful.
  • Immediate notice if you also pursue the claim yourself or through another provider.

No guarantee of success

The calculator provides an automated first assessment. It is not legal advice and does not guarantee that a claim will succeed; the outcome depends on the airline, the evidence and, where relevant, the court.

Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence we are liable only for breach of a cardinal obligation and limited to the foreseeable damage typical of this type of contract. Statutory provisions of the RDG take precedence where they apply.

Governing law

German law applies, and the place of jurisdiction is Berlin, unless a mandatory consumer protection rule in your country of residence provides otherwise.
